This research study uses the descriptive case analysis approach on an e-commerce company in the Philippines, examining how the company manages its intellectual properties (IP) with a focus on trademarks and copyrights to determine the issue surrounding the applicability of the
Intellectual Property Code of the Philippines (IPC) in online platforms. Using Reichenbach's Common Cause Principle and Confounder Definition (2021), the study examines the company's IP protection, issues, and remedial actions. IP protection is the Confounder variable that
determines the types of issues and remedies of the company. The results also show that the company uses judicial and extrajudicial (technological) methods for IP protection. The company
also pursues extrajudicial remedies before judicial remedies. These results suggest that the company may rely less on the IPC’s protections and remedies as they lean more on technological
means. The study suggests that digital image recognition tools and trademark watch services may be used in detecting when IP infringement occurs. The study highlights the need for strong
IP laws, effective enforcement mechanisms, and responsible conduct by online platform authorities with the cooperation of government IP offices to ensure effective IP management in the digital era.
